Obtaining U.S. Title Insurance When You Purchase Property In Mexico

U.S. Title Insurance can be obtained via financial institutions. Its purpose is to guarantee that the commercial transaction and property registration is valid, providing legal certainty on the property title’s validity. 

A Title Insurance Policy provides security against the loss of land as a result of a title problem. Title Insurance can be purchased with or without limitations and exclusions.

Title insurance is not an expensive proposition.  The title investigation cost will depend upon the area where the property is located and can range from $450 USD to 3,000.USD.  Actual cost will depend upon whether or not a title database has been created. When a new database must be created more time, and hence, greater cost, will be involved. The premium, a one time payment, will run from 6.00 USD to 7.50 USD per 1,000. USD valuation, plus tax.

Thus an insurance policy on a 200,000. USD property can cost $1,200 to 1,600. USD. which seems to be a small amount to pay for the security afforded.  The prudent buyer will always include the cost of title insurance investigation and policy in his closing budget.

A Fideicomiso (Living Trust) does not take the place of or exclude the need for Title Insurance.
When purchasing Title Insurance in Mexico, be sure to read the master policy thoroughly and check for limitations and exclusions and also make sure that the policy is on the land not just the Fideicomiso.
